- Septic failure could be caused by a lot of reasons that may or may not involve any or all of the parties involved. If you have a tile field, it could be that which has failed. If you have high ground water. the system could be getting full by that means. Ask your neighbors about the problem, . did they know of the previous owners having chronic problems with the system. Was the system pumped because the owners knew of the problems and wanted to conceal it as they were selling the house. I do not think your insurance Co will help at all, but something fishy was certainly going on and I will bet the previous owners knew about it
- You must consult the attorney regarding this one as it is best to follow their advice regarding seller fraud. It is most likely their responsibility to make the repair based on the local law in the County you reside. If you turn it in on your insurance you will show up in a risk pool for at least the next 7 years and could have increased rates from this being claimed.
